01Service Description
eSIM Today provides digital eSIM data plans for international travel. We act as a reseller, sourcing eSIM profiles from third-party providers and delivering them to you electronically via QR code and activation instructions. For more information about our reseller status, see the 'Reseller Status' section below.
02Reseller Status
eSIM Today is a reseller of digital eSIM products. We do not operate as a telecommunications network provider. eSIM services are delivered through third-party network operators. We source eSIM profiles from our provisioning partners and deliver them to you electronically.
03Eligibility
You must have a device that supports eSIM technology to use our products. It is your responsibility to verify device compatibility before purchase. We are not responsible for purchases made for incompatible devices.
04Orders and Payment
All prices are displayed in the selected currency and include any applicable fees. Payment is processed securely by Stripe. Once payment is confirmed, your eSIM will be provisioned and delivered to your email address. All sales are final once the eSIM has been provisioned.
05Digital Delivery
eSIM profiles are delivered digitally via email containing a QR code and activation instructions. Delivery is typically instant but may take up to 30 minutes in rare cases. You are responsible for following the provided installation instructions for your device.
06Refunds
eSIMs are digital products that are delivered immediately on purchase. At checkout you expressly consent to immediate delivery and acknowledge that you waive your 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, reg. 37. We will still issue a full refund in either of these two cases: • The QR code has never been installed on any device. If you change your mind before installing, contact us within 14 days of purchase and we will refund you in full, no questions asked. • The eSIM cannot be provisioned or activated due to a technical fault on our side. If the profile fails to install on a known-compatible device or activation never completes through no fault of your own, we will refund you in full after a brief troubleshooting check. Once the eSIM has been installed on a device it counts as used and is no longer refundable except where defective as above. Refund requests must be made within 30 days of purchase by contacting our support team. Refunds are issued to the original payment method. 07Digital Content Quality Standards
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose, and as described. An eSIM product meets our quality standards if: • The eSIM profile downloads and activates successfully on a compatible device • The data package provides the stated capacity (subject to standard measurement variance by the network operator) • Network coverage is available in the stated country or region • The validity period matches the product description Issues outside our control do not constitute a quality defect, including but not limited to: device incompatibility, local network congestion, roaming partner limitations, or user error during installation. If your eSIM does not meet these quality standards, please contact us for assistance.
08Cancellation Rights
Under the Consumer Contracts Regulations 2013, you normally have the right to cancel a distance purchase within 14 days. However, because eSIM profiles are digital content that is delivered immediately upon purchase, you will be asked to acknowledge at checkout that: • You agree to immediate delivery of the digital content • You understand that this waives your 14-day cancellation right This acknowledgement is required before your order can be processed. Without it, we cannot deliver your eSIM. Your statutory rights under the Consumer Rights Act 2015 (regarding quality, fitness for purpose, and description) are not affected by this waiver.
09Pricing
All prices are displayed in USD. No additional taxes are applied at checkout. The total price shown before payment is the final price you will be charged. We reserve the right to change prices at any time, but price changes will not affect orders that have already been placed.
10Merchant of Record — EU customers
For purchases by customers in the 27 EU member states, Stripe Payments Europe, Limited (a private company limited by shares, registered in Ireland) acts as Merchant of Record. This means Stripe — not OHA Labs Limited — calculates EU VAT at your billing country's rate, collects it as part of the payment, and remits it to the appropriate tax authority on our behalf. Your invoice from Stripe will identify Stripe Payments Europe, Limited as the seller of record for VAT purposes. Your purchase contract for the eSIM data plan itself remains with OHA Labs Limited, which means we remain responsible for the quality and delivery of the product, customer support, refunds (handled jointly with Stripe), and the statutory consumer-rights protections set out elsewhere in these Terms. For purchases by customers OUTSIDE the EU (including the United Kingdom, United States, and Asia-Pacific), payments are processed by Stripe on the standard rail with OHA Labs Limited as the sole merchant of record. OHA Labs Limited is not currently registered for UK VAT.
11Account Deletion
You may delete your account at any time through your account settings. When you delete your account: • All your personal data will be permanently deleted • Active eSIMs will be suspended and you will lose access to manage them • Unused eSIMs that have not yet been installed on a device will be cancelled • No refunds will be issued for active or cancelled eSIMs • Order records will be retained in anonymised form as required by law (UK Companies Act 2006) Before deleting your account, you must disable any active auto top-up configurations. Account deletion cannot be undone.
12Acceptable Use
You agree not to: • Use our service for any unlawful purpose • Attempt to gain unauthorised access to our systems • Resell or redistribute eSIM profiles without authorisation • Use automated tools to scrape or access our website • Abuse promotional codes or discount offers
13Limitation of Liability
To the maximum extent permitted by law, eSIM Today shall not be liable for any indirect, incidental, or consequential damages arising from the use of our service. Our total liability shall not exceed the amount paid for the specific product in question. This does not affect your statutory rights as a consumer.
14Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the service after changes constitutes acceptance of the updated Terms.
15Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16Complaints and dispute resolution
We aim to resolve every customer issue quickly and fairly through our internal support channel. If you have a complaint, please contact us at [email protected]. We will acknowledge your complaint within two working days and provide a substantive response within 14 working days where possible. If a complaint requires longer investigation, we will tell you why and give you an expected timeframe. Alternative Dispute Resolution (ADR): under the UK Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 reg. 14, we are required to tell you whether we are obliged or have voluntarily agreed to use a certified ADR provider to resolve disputes. OHA Labs Limited is NOT obliged to use ADR and has NOT voluntarily joined an ADR scheme. If you remain dissatisfied after exhausting our internal complaints procedure, your rights to take the matter to a competent court — typically in England and Wales — are not affected by this clause. EU customers may, in addition to the above, use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to submit a complaint about an online purchase. The ODR platform forwards complaints to an ADR provider; please note that OHA Labs Limited has not joined an ADR provider, so resolution via ODR depends on the consumer choosing a voluntary route.
17Language
These terms are provided in multiple languages for your convenience. In the event of any discrepancy between the English version and any translated version, the English language version shall prevail and govern.
